General Service Terms & Conditions

This document contains the terms of the agreement between the client and Ashlin Technology Services (also referred to as ATS).
If the client does not agree to these terms and conditions, Ashlin Technology Services reserves the right to refuse service.

Limited Liability

The client must accept risks associated with the repair or any IT service. Risks could damage the client’s property and could mean the loss or corruption of data. Our clients must accept that ATS is not liable for such damage or loss.

If there is unintentional damage to components, peripherals, the screen or any other equipment regarding a client’s computer, ATS will, whenever possible, replace the damaged component/equipment. In some circumstances, ATS will replace the component/equipment with a refurbished or second-hand part at a similar or higher value at the time.

While ATS will take all due care to ensure the client’s property and data remain intact, ATS strongly encourage that, if possible, a client should do a full backup of data and system before ATS provide any repair or service.

Suppose the client does not have any data backups and requires assistance backing up their data before ATS provide any services. In that case, the client must inform ATS before proceeding with any work.

Confidentiality and Privacy

The Privacy Policy outlines the confidentiality and privacy of the client’s information.

We reserve the right to update or amend these terms and conditions. We will inform our customers of any changes to these terms and conditions by posting the revised details on our website.

Payment

Our default payment terms is referred to as ‘Payment On Completion’, where by payment for all hardware and labour is due in full upon completion of the agreed services and that full payment is required prior to the release of the client’s property.

Businesses may request to have alternate payment terms applied to align with their business structures (7 days, 14 days etc) but the acceptance of these terms is at the discretion of Ashlin Technology Services and these alternate payment terms are not assumed to apply by default.

Payment arrangements for extenuating circumstances can also be requested by the customer upon discussion with ATS management, but is also not to be assumed by default.

Late fees of $5 per week may apply if the completed services that were agreed upon are not paid in full within 14 days of the invoice due date, late fees will automatically apply if customers do not contact us to make payment arrangements and discuss the situation with us.

Even if late fees are to occur, should payment is not made in full within 30 days (without contact able to be made) or 60 days (if contactable) of customer receiving their notification of job completion then any property left in our possession will be deemed as abandoned and repurposed to recoup costs associated with your original service/repair request.

If the works completed for an overdue unpaid invoice did not involve property left in our possession (eg onsite work / remote support or consultation work etc) we reserve the right to enlist the services of debt collection agencies to retrieve the unpaid invoice which may have an adverse effect on your credit rating, additional collection costs for these services may also apply.

Ashlin Technology Services also reserve the right to refuse future work being completed for any customers with previous payment issues and/or the right to request payment in full before beginning any future work.

Direct Debit

Payment Information Storage: We understand the importance of keeping your payment information secure, which is why we do not store any payment information. All payment information is stored by our trusted and secure third-party payment processor, Stripe. This means that we do not have access to your sensitive payment information and it is kept safe and secure by Stripe.

Direct Consent: We value the trust you place in us when it comes to handling your financial information. Therefore, we only enable Direct Debit with your direct consent. This means that we will never set up a Direct Debit on your account without your explicit permission.

Payment Processing: We use Direct Debit as a convenient way for you to make payments for our services. When you provide us with your Direct Debit details, we will submit your payment information to Stripe, who will process the payment on our behalf. Stripe is fully compliant with Payment Card Industry Data Security Standards (PCI DSS), ensuring that your payment information is always secure.

Payment Scheduling: By providing us with your Direct Debit details, you authorise us to schedule payments for our services on the agreed date. If there are any changes to the amount or date of the payment, we will notify you in advance of the change and provide you with an opportunity to cancel or amend the Direct Debit.

Cancellation: You may cancel your Direct Debit at any time by contacting us directly or by contacting your bank. If you cancel your Direct Debit before the agreed payment date, you will still be liable to pay for any services we have provided up to that point.

Dispute Resolution: If you have any issues or disputes regarding your Direct Debit payments, please contact us directly. We will work with you to resolve any issues as quickly as possible. If we are unable to resolve the issue, you may refer the matter to your bank, who will investigate the issue and provide you with a resolution.

Property

Any client’s property (hardware/software/peripherals or other associated item left in our possession as part of the job) that is not collected within:

  • 30 days of notification to collect (and services have not been paid for)
  • 3 months after date of notification to collect (and the services have been paid for)

will become the property of ATS.  At this time we reserve the right to dispose or use the machine and components or peripherals to recoup costs associated with your original service/repair request.

Warranty

Any computer components purchased by customers and installed on a client’s behalf are covered by the manufacturers or sellers warranty (if applicable).  The hardware in these types of jobs are not covered by a warranty with Ashlin Technology Services.

In most cases with a customers component failing under warranty and it is a repair job that we have previously undertaken, ATS will supply labour to reinstall the warranty replaced part for discounted rate.

We provide a 3 month warranty on our labour for general repairs and IT services if it is deemed to be a fault as a result of our work and not an additional hardware/software/configuration fault unrelated to the original works.

All refurbished machines purchased from ATS come with a 3 month hardware warranty unless otherwise stated at the time of purchase on your invoice.
By default any new devices purchased from ATS come with a 12 month hardware warranty unless otherwise stated at the time of purchase on your invoice.

For some purchases, additional warranties from the hardware manufacturers themselves may apply after the ATS warranty periods expire and ATS can assist in facilitating the warranty replacements of these devices with the manufacturers on your behalf however some labour charges for this kind of service may apply.

Any changes or modifications made by the client during the warranty period that results in errors or damage to the services provided by ATS will void the warranty.

Transportation

If necessary the client authorises Ashlin Technology Services staff and contractors to receive and transport your machine back to our office (and associated repair facilities) for repair as applicable with customers to be informed at the time if necessary for us to do so to complete your ticket.

Services and Pricing

ATS will always endeavour to maintain that service offerings and pricing on our website are up-to-date.  Pricing and services advertised elsewhere on the internet may be out-of-date.  The prices and services as stated on our website shall override any other advertised price.

All content on this website is the property of and copyrighted by Ashlin Technology Services (ATS).  Any reproduction, modification, republication or distribution of the content of this website is strictly prohibited.

Any information provided on this website should not be taken as fact or 100% accurate.  ATS endeavour to provide useful and accurate information to our clients.  However we will not be held liable should the information be incorrect or out-of-date.

ATS also endeavour not to infringe any copyright of another other business or organisation.

Malware Removal

While we use the most modern and up to date malware detection and removal tools available and have a very advanced kit of software and tools at our disposable. It is very difficult to provide a warranty of this type of service as whilst a machine may leave our office clean of all malware, the client’s computer may later once again become infected either with the same malware or a new type of malware.

This could be based on a variety of factors such as customer has been targeted again, access to machine has been granted to others after our repair, another infected device./peripheral/storage medium at the customers location could still be infected and spread back to the cleaned machine (as well as a number of other factors).

Should this occur we reserve the right to the determination of whether the malware infection occurred after a successful malware removal service or our malware removal services was not 100% successful.  If we determine the error was on our part we will undertake a second malware removal service at no additional cost, if the malware was determined to be reinfected by other means additional costs may apply.

Additional Technical Service Terms & Conditions

Data Backup

By default ATS will only backup your data if the service specifically requires this or the client requests this service.  In undertaking a backup we will endeavour to copy all files and data possible.  We will not be liable for failure to copy data that is located in an obscure location.  It is the responsibility of the Client to inform us should files and folders be located in an unusual location on the hard drive.

ATS generally only backup user files and folders (unless otherwise specifically requested).  The backup does not always include installation of 3rd party programs beyond the standard operating system and current list of ATS “default applications”.  Any addition programs will need to either be re-installed by the client or we can attempt to install your other programs, but it will be for an additional charge. Usually the settings (app data) for these programs are contained within the User data backup and can be restored upon successful re-installation of the 3rd party software.

Subject to change our default list of applications currently includes Java, Flash, Adobe Reader, Libre Office (if customer does not supply a valid MS Office product code for a currently support version; or one can not be extracted from their existing data), Chrome/Firefox or other mainstream supported web browser, CD Burner XP and VLC Media Player.

Customers need to be able to provide the installation media, serial numbers, licence keys or access accounts for any 3rd party programs they wish for us to re-install. Extraction of this information from your existing data is not always possible due to hardware failures, security policies, application/program restrictions and/or licencing guidelines.

Data Clones

Similar to that of Data Backup, ATS will if the service requires it or customer requests it; clone all your data from an old hard drive to a new one as applicable. In undertaking a clone we will endeavour to copy all files and data possible byte for byte.  In some circumstances due to hardware malfunctions/failures in the old hard drives a 100% like for like clone is not always possible (as some data may be corrupted or unreadable).

If this occurs, we will attempt to utilise the existing clone and manually transfer the remaining files, however ATS is not liable for any data that cannot be cloned or manually transferred due to hardware issues.

Some programs have mechanisms built into them that require software to be reinstalled/reactivated in the event of a hard drive replacement/clone. If this is the case, we will inform the customer of which programs require remediation and work with them to restore the programs to a functioning state – some additional labour charges may apply for this service.

Customers need to be able to provide the installation media, serial numbers, licence keys or access accounts for any 3rd party programs they wish for us to re-install. Data Restoration

In the event of access issues with customer data, we will endeavour to the best of our abilities to utilise best in breed data recovery software in-house to retrieve missing data (after consultation and approval to proceed from customer), however in the event we are unsuccessful in recovering data we can offer an express diagnosis referral voucher to our specialist data recovery center partner in Melbourne (valued at $165)

Any additional services provided by our recovery partner (Technetics) become an agreement between the customer and Technetics and their terms and conditions then apply to your drive and data after that.

Screen Replacements

ATS accept no liability for screen damage caused by a client after replacement and this is not covered under any warranty.   Any screen repair faults need to be reported within a maximum of seven days of service and if deemed to be a hardware fault with the repair, this will be repaired again at no charge.

Direct Debit Policy

Introduction

At Ashlin Technology Services, we offer direct debit payment options for our customers. We take the security of our customers’ payment information seriously and have implemented policies to ensure that this information is kept secure.

Payment Information Storage

We do not store payment information on our servers. All payment information is securely stored with a third-party payment processor called Stripe. Stripe is a PCI Service Provider Level 1 which is the highest grade of payment processing security. Stripe uses industry-standard encryption to protect sensitive information.

Direct Debit Consent

We only enable direct debit payments with the express consent of our customers. Customers who choose to pay by direct debit must provide their card details and authorise Ashlin Technology Services to automatically charge their card for payment.

Direct Debit Setup and Changes

Customers can set up direct debit payments by contacting our customer service team. Any changes to the payment details, including cancellations, must also be made through our customer service team.

Payment Scheduling

Direct debit payments will be scheduled on a date agreed upon between Ashlin Technology Services and the customer. Customers will be notified of the payment amount and date at least 7 days in advance of the payment due date.

Payment Disputes and Refunds

Customers have the right to dispute any payment made by direct debit within 30 days of the payment date. We will investigate any payment dispute and provide a resolution as quickly as possible. If a payment was made in error, we will issue a refund within 5 business days of the dispute resolution.

Direct Debit Cancellation

Customers can cancel their direct debit payment option at any time by contacting our customer service team. Customers who cancel their direct debit payment option will need to provide an alternative payment method.

Amendments to this Policy

We reserve the right to update or amend this Direct Debit Policy at any time. We will notify our customers of any changes to this Policy by posting the revised policy on our website.
